1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Com AI Technologies Private Limited governing your use of the ComAI platform, APIs, AI agents, and related services (collectively, the "Service").
By creating an account, connecting a store, or using any ComAI feature, you agree to these Terms, our Privacy Policy, Subscription Policy, and all applicable policies referenced herein.
If you are entering into these Terms on behalf of a company or organization, you represent that you have authority to bind that entity.
2. SaaS Platform Usage
- ComAI is provided as a subscription-based software-as-a-service platform
- We grant you a limited, non-exclusive, non-transferable license to access the Service during your active subscription
- You may connect authorized eCommerce stores and configure AI agents within your plan limits
- API access, webhooks, and integrations are subject to rate limits and fair usage policies
- We may update features, interfaces, and underlying technology without prior notice
3. Account Responsibilities
- Maintain accurate account information including business name, billing details, and contact information
- Safeguard login credentials and API keys; notify us immediately of unauthorized access
- Ensure all team members comply with these Terms and applicable laws
- Obtain necessary consents from end-customers before processing their data through ComAI
- Comply with Shopify, WooCommerce, Meta, WhatsApp, and telephony provider terms of use
4. AI-Generated Content
ComAI agents generate automated responses, recommendations, and communications using artificial intelligence. While we strive for accuracy, AI outputs may contain errors, omissions, or inappropriate content.
You are solely responsible for reviewing AI agent configurations, monitoring conversation quality, and ensuring AI-generated content complies with your brand standards, consumer protection laws, and advertising regulations.
ComAI does not guarantee that AI-generated content will be error-free, legally compliant, or suitable for every business context. You assume all risk associated with deploying AI agents to interact with your customers.
We recommend human oversight for high-stakes interactions including payment disputes, medical claims, legal advice, and financial recommendations.
5. Subscription Terms
Access to ComAI features is governed by your selected subscription plan and billing interval (monthly or annual). Plan limits on stores, users, AI credits, and channel integrations are enforced automatically.
Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date. Pricing is displayed at checkout and may change with 30 days' notice for subsequent renewal periods.

6. Acceptable Use & Abuse Policy
Violation of this policy may result in immediate suspension or termination of your account without refund.
- No spam, unsolicited bulk messaging, or TRAI DND violations via WhatsApp or calling agents
- No fraudulent, deceptive, or misleading AI-generated communications
- No processing of illegal goods, prohibited content, or regulated products without required licenses
- No reverse engineering, scraping, or unauthorized access to ComAI systems
- No reselling or sublicensing the Service without written authorization
- No activities that degrade platform performance or harm other customers
7. Intellectual Property
ComAI retains all rights, title, and interest in the platform, software, AI models, documentation, and branding. Your content, store data, and customer conversations remain your property.
You grant ComAI a limited license to process your content solely to provide the Service.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY INDIAN LAW, COMAI AND COM AI TECHNOLOGIES PRIVATE LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST REVENUE, LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to ComAI in the twelve (12) months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
9. Termination
- You may cancel your subscription at any time through the billing center or by contacting support
- We may suspend or terminate accounts that violate these Terms or applicable law
- Upon termination, your access continues until the end of the current billing period for paid subscriptions
- Data export is available for 30 days after termination; thereafter data may be permanently deleted
10. Governing Law & Disputes
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Gurgaon, Haryana, India.
Before initiating legal proceedings, parties agree to attempt good-faith resolution through written notice to support@comai.in with a 30-day cure period.
